Nintendo is a weird one .... and honestly I think the only way to make that work would be to have a separate channel dedicated to Nintendo videos. They want a revenue share

Thanks for writing this together, I just want to throw in my two cents about this topic.

Most gaming companies do allow you to use their games and part of their branding without any issues, just a few rules of thumb:
  • It should not be behind a "paywall" e.g. someone needs to pay to see that video (YouTube Red exclusive)
  • It shouldn't hurt the original game or the brand (Just bashing the game or messing with the company)
  • It should be PG
As of the "hurting the original", it mostly is the same as with a normal defense for Fair Use, you are able to use that content or make videos on it as long as it's not defacing the company that made the game or the game. So what I want to say to everyone who wants to do gaming on YouTube is:
  • Check with the company individually (Support pages) about using the game as gameplay
  • Check with them for the music in the game or get rid of that music
  • Make the content individual
From my experience these steps really help, especially for less known indie games. Also sometimes asking for claims for music to be removed if the music is part of the game you play and is under Fair Use you can really get them removed is if you ask the claimant company nicely.
