If the claim was justified and you can't go by Fair Use you'll fail every time. There's no 100% way to win every time though if you keep the amount of copyrighted content in the video low you'll get your chances higher. Also directly contacting companies, especially smaller labels, often helps more.
Typically it depends on how you structure your argument to the copyright claim and whether or not you could argue Fair Use. While this isn't a given argument - meaning you won't always win when using it as the definitions of Fair Use are openly subjective, its much easier to counter a claim. I also find taking emotion out of the argument and backing up what you saying with acts / statutes help (basically how the law is on your side).
